Not by itself. A bank reports to the countries where its due diligence shows you are resident for tax purposes. If your file still points to your old country, your data can still go there.
What the bank looks at
For new accounts, the bank relies on your self-certification and tests it against its records. For older accounts, it searches its records for signs of residence, called indicia. The UAE guidance lists these.
- An address or mailing address in that country.
- A phone number there and no local number.
- Standing instructions to pay money to an account there.
- A power of attorney or signatory with an address there.
Where the bank finds indicia, it treats you as resident in each country concerned. That is how one account can end up reported to more than one country, as explained in Can I be reported to two countries at once?
How to put it right
An address, phone number or standing instruction can be cured. You give the bank a self-certification that leaves out the old country, plus documentary evidence of residence elsewhere. A certificate of residence issued by a government body counts as documentary evidence, so the bank may ask for a UAE tax residence certificate. For a UAE residence claim, banks may also rely on a valid residence visa and ask where else you are resident and where you paid income tax last year.
Your old country decides your residence there
Each country sets its own residence rules. If your old country still treats you as resident, you must list it on the form. See How do I become tax resident in the UAE?
An example
Tomas Novak moved from the Czech Republic to Dubai and ceased to be resident there. His Czech mobile number is still on his account at an international bank, and he has no UAE number on file. The bank treats him as Czech resident. He gives a new self-certification showing the UAE only, adds his UAE number and supplies his UAE tax residence certificate.
Quick questions
Does a UAE residence visa end my old residence?
No. Your old country applies its own rules, which usually look at days, homes and ties there.
How quickly must the bank update my file?
Under the UAE rules, after a change it must obtain a new form and evidence by the later of year end or 90 days after learning of the change.
